In Kentucky, the Division of Driver's Licensing keeps of record of all moving traffic violations of each driver who maintains a Kentucky driver's license. No points are assessed against driver's convicted of a DUI because the law mandates revocations of the Kentucky driver's license.
Points are set forth in the Kentucky Administration Regulation. ( 601 KAR 13:025 ) The following is a brief list of points for driving offenses:
- Speeding 15 MPH or less over the limit - 3 points (except as provided in KRS 186.572)
- Speeding 16 MPH or more, but less than 26 MPH, over the limit - 6points
- Failure to stop for church or school bus - 6 points
- Improper passing - 5 points
- Reckless driving - 4 points
- Driving on wrong side of road - 4 points
- Following too closely - 4 points
- Failure to yield to emergency vehicle - 4 points
- Changing drivers in a moving vehicle - 4 points
- Vehicle not under control - 4 points
- Stop violation (electric signal, railroad crossing, stop sign) - 3 points
- Failure to yield - 3 points
- Wrong way on one-way street - 3 points
- Too fast for conditions - 3 points
- Too slow for conditions - 3 points
- Improper start - 3 points
- Improper driving - 3 points
- Careless driving - 3 points
- Failure to yield left lane - 3 points
- Improper lane usage - 3 points
- Failure to illuminate headlights - 3 points
- Failure to dim headlights - 3 points
- Any other moving hazardous violation - 3 points
- Commission of a moving hazardous violation which involves an accident - 6 points, or
- Combination of two (2) or more moving hazardous violations in one (1) occurrence - 6 points.
If an adult driver (eighteen (18) years or older) accumulates six (6) or more penalty points within a two (2) year period, the Kentucky Transportation Cabinet may send a letter to the address shown on the driver's driving history record that shall advise them of the number of penalty points on their driving history record and list the penalties which may be imposed if the driver accumulates twelve (12) points within two (2) years.
The Kentucky Transportation Cabinet may suspend the driving privilege of a person:
- Eighteen (18) years of age or above who accumulates twelve (12) penalty points within a period of two (2) years;
- Less than eighteen (18) years of age who accumulates six (6) or more penalty points within a period of two (2) years.
- Six (6) months for the first accumulation;
- One (1) year for the second accumulation; and
- Two (2) years for a subsequent accumulation within a two (2) year period.
